These Terms & Conditions govern the use of the Shakhtar Academy Toronto website. They are published for informational purposes and do not require a signature. This document should be linked in the website footer alongside the Privacy Policy and Cookies Policy.

(the “Site”) and any associated Academy web domains operated by Canada Football Sports Investment Inc., operating as Shakhtar Academy Toronto (the “Academy”, “we”, “us”, “our”).
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
These Terms govern use of the Academy’s website only. Program participation, payments, liability, and conduct are governed by separate agreements presented at registration — specifically the Participant Waiver, Code of Conduct, and Refund Policy — which participants and parents/guardians sign electronically through Playmetrics.
1. USE OF THE SITE
The Site is provided for informational, registration, and communication purposes related to Academy programs and services. You agree to use the Site only for lawful purposes and in a manner consistent with these Terms.
You agree not to:
- Use the Site for any unlawful purpose or in violation of applicable law
- Interfere with or disrupt the Site, its servers, or connected systems
- Attempt to gain unauthorised access to the Site, user accounts, or backend systems
- Upload or transmit malicious code, viruses, or harmful data of any kind
- Use automated means (including bots or scraping tools) to access or copy Site content without prior written permission from the Academy
2. INTELLECTUAL PROPERTY
All content on the Site — including text, graphics, logos, images, videos, design elements, and branding — is owned by or licensed to the Academy and is protected by applicable Canadian and international intellectual property laws.
You may view, download, or print content solely for personal, non-commercial use. Any other use, reproduction, modification, distribution, or commercial exploitation of Site content requires prior written permission from the Academy.
The Shakhtar Academy Toronto name and branding are used under a licensed arrangement. Unauthorised commercial use of the Academy’s name, logo, or branding is strictly prohibited.
3. ACCURACY OF INFORMATION
We strive to keep information on the Site accurate and up to date. However, the Site may contain information that is incomplete, outdated, or subject to change without notice. Program details, schedules, fees, locations, and policies may be updated at any time.
Where discrepancies exist between information on the Site and the terms of a signed registration agreement, the signed agreement will govern.
4. THIRD-PARTY LINKS
The Site may contain links to third-party websites or services — including governing body websites, facility partners, or social media platforms — provided for convenience only. The Academy does not control third-party sites and is not responsible for their content, accuracy, services, or privacy practices.
Your use of any third-party site is at your own risk and is subject to that site’s own terms and conditions. We encourage you to review the terms and privacy policies of any external sites you visit.
5. ONLINE REGISTRATION & PAYMENTS
Program registrations and payments are processed through Playmetrics, a third-party program management platform. Use of Playmetrics may be subject to its own terms and conditions in addition to these Terms.
All refund and cancellation rights and obligations are governed exclusively by the Academy’s Refund & Financial Commitment Policy, which is provided to and accepted by registrants at the time of registration through Playmetrics.
6. LIMITATION OF LIABILITY — WEBSITE
To the maximum extent permitted by applicable Ontario and Canadian law, the Academy will not be liable for any damages arising out of or related to your use of, or inability to use, the Site, including any indirect, incidental, special, or consequential damages.
The Site is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
This limitation applies to the website only. Liability in relation to program participation, personal injury, and physical activities is addressed separately in the Participant Waiver, Release of Liability & Indemnity Agreement.
7. PROGRAM PARTICIPATION
Participation in Academy programs involves inherent physical risks and is governed by separate agreements, including the Participant Waiver, Release of Liability & Indemnity Agreement and the Parent & Guardian Code of Conduct, accepted at registration.
Nothing on this Site constitutes medical, legal, safety, or professional advice. Parents and guardians are responsible for assessing the suitability of participation for their child and for sharing relevant medical or health information with the Academy where necessary for safety.
8. USER SUBMISSIONS
If you submit information through the Site — including enquiry forms, registration information, or contact requests — you confirm that the information you provide is accurate and that you have authority to provide it.
Submitted information will be used to respond to your enquiry and administer Academy programs, in accordance with our Privacy Policy. We will not use submitted information for purposes inconsistent with those stated at the time of collection.
9. BRAND & LEGAL RESPONSIBILITY NOTICE
Shakhtar Academy Toronto is operated by Canada Football Sports Investment Inc. under a licensed brand and program arrangement. The Academy is solely responsible for the operation of its website, programs, and activities.
FC Shakhtar Donetsk and its affiliated entities do not assume legal responsibility for the Academy’s operations. These Terms do not create rights or obligations between FC Shakhtar Donetsk or its affiliates and any third party.
10. GOVERNING LAW — WEBSITE DISPUTES
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute arising from your use of the Site will be subject to the exclusive jurisdiction of the courts of Ontario, unless applicable law requires otherwise.
Disputes related to program participation, registration agreements, or financial commitments are subject to binding arbitration as set out in the Participant Waiver (Section 9), not these Terms.
11. CHANGES TO THESE TERMS
We may update these Terms from time to time. The most recent version will always be posted on the Site with an updated “Last Updated” date at the top of this document. Your continued use of the Site after any update is posted constitutes your acceptance of the revised Terms.
